RUN INSYNC

A project of Adventures Beyond Barriers Foundation

The rules that govern your registration and participation

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Run InSync booking platform ("Platform") and your registration for and participation in the Run InSync running event ("Event") operated by Adventures Beyond Barriers Foundation ("ABBF", "we", "us", "our"). By using the Platform, registering for the Event, or participating in the Event, you agree to these Terms and the policies and event-specific rules expressly incorporated by reference, including the Privacy Policy and Return & Refund Policy. Where separate race rules, category rules or event instructions apply, they also form part of the terms governing that Event activity.

These Terms are intended for users in India and are subject to mandatory consumer, privacy, accessibility and other statutory rights that cannot lawfully be excluded or waived.

2. About the Event

Run InSync is an inclusive running event organised by ABBF under the theme "Together We Can". The Event may bring together participants with and without disabilities, support persons/crews and other eligible runners on shared or category-specific routes, consistent with the Event rules published for the relevant edition.

The Event may include multiple race categories and distances, including open and reserved categories, with the specific date, start time, route, category eligibility and other operational details published on the Platform or otherwise communicated to participants for the relevant edition. Registration fees and any proceeds generated through the Event support ABBF's programmes and event operations as determined by ABBF, subject to applicable law.

3. Definitions

  • "Applicable Law" means laws, rules, regulations, notifications and binding directions applicable to ABBF, the Platform, the Event or the relevant transaction in India, as amended from time to time.
  • "Event-Specific Rules" means race/category rules, cut-off times, venue instructions, health and safety instructions, accessibility arrangements and other instructions communicated for the relevant edition.
  • "Participant" means the individual whose registration is accepted for the Event.
  • "Registration" or "Entry" means the participation right granted for a specified Event/category.
  • "Registration Fee" means the amount payable for the relevant Entry as displayed at checkout.
  • "User" means any person who accesses or uses the Platform.

4. Eligibility

You must meet the minimum age and any other eligibility requirement specified for your chosen race category. Participants below 18 years must register through a parent or lawful guardian where the Event permits minors to participate, and the parent or guardian must complete the required consents and accept these Terms on the minor's behalf.

You are responsible for assessing whether participation is appropriate for you and for obtaining medical advice where reasonably appropriate. ABBF does not provide medical advice or a medical fitness certification. Event-specific medical or safety requirements may apply and will be communicated before participation.

ABBF may verify age, identity, disability eligibility or other category requirements using documents or information reasonably required for the Event. If an application is rejected before confirmation or a confirmed entry is later found to be based on false or materially misleading information, ABBF may cancel the entry in accordance with the Return & Refund Policy and applicable law.

5. Registration, Confirmation, Pricing & Payment

Registration is completed only when the applicable payment has been successfully processed and ABBF/Platform has issued the relevant confirmation, subject to any stated eligibility, capacity or verification conditions for the Event/category.

The applicable Registration Fee, taxes and any separate convenience, booking, merchandise or other charges will be displayed before payment. You should review the category, distance, participant details, total payable amount and Event-specific terms before completing the transaction.

You are responsible for ensuring that the information you submit (including name, age, category and contact details) is accurate and current. ABBF is not responsible for problems caused by inaccurate, incomplete or misleading information supplied by you, subject always to any liability that cannot lawfully be excluded.

Payments are processed through the payment methods displayed at checkout, including Razorpay where enabled. Your use of a payment provider may also be subject to that provider's terms. ABBF does not ask you to provide your UPI PIN, full card credentials or net-banking password to ABBF staff.

If a material pricing or technical error is identified before or after payment, ABBF may correct the error and, where an order is cancelled because of the error, refund the amount actually charged to the original payment method, subject to applicable law.

6. Bib Number, Kit & Timing

Your bib number and any timing chip issued to you are non-transferable and must be worn as instructed during the Event. Running under another person's bib, or allowing another person to run under yours, is prohibited and may result in disqualification without refund.

ABBF may use reasonable identity, eligibility or bib-verification measures at collection and/or the Event venue. Any kit distribution, T-shirt size, timing, medal or certificate arrangements are subject to the Event-specific information communicated for the relevant category.

7. Code of Conduct and Prohibited Conduct

All participants are expected to:

  • Follow instructions from race marshals, volunteers, medical staff, safety personnel and traffic/police personnel.
  • Behave respectfully toward fellow participants, volunteers and the public, in keeping with ABBF's mission of inclusion.
  • Not use prohibited substances or engage in conduct that compromises fair play or safety.
  • Follow the designated race route and not take shortcuts.

Participants must not impersonate another person, tamper with timing equipment, harass or threaten another person, damage venue/property, interfere with event safety operations, or engage in unauthorised commercial promotion or resale of Entries.

ABBF may disqualify or remove a participant for a material or safety-related violation of this Code of Conduct or the Event-specific rules. Refund consequences are governed by the Return & Refund Policy and applicable law.

8. Health, Safety & Assumption of Risk

Participation in a running event carries inherent physical risk, including but not limited to injury, dehydration, heat exhaustion, and, in rare cases, more serious medical events.

By registering and participating, you acknowledge that you voluntarily accept the ordinary and inherent risks of endurance sport and agree to follow reasonable safety instructions. ABBF will make reasonable efforts to provide event safety measures, hydration/water stations and access to medical or emergency support appropriate to the Event, but these measures cannot eliminate every risk or guarantee a particular medical outcome.

Where you provide emergency contact or relevant health information, you authorise ABBF and relevant event medical/safety personnel to use that information for a genuine safety or emergency purpose, subject to applicable law.

9. Liability and Release

Neither ABBF, nor its directors, trustees, officers, employees, representatives, or volunteers (collectively, the "ABBF Parties") shall be responsible or liable, in any manner whatsoever, for any accident, injury, disability, illness, or death suffered by a participant before, during, or after the Event, or for any loss or damage to personal property, however caused. By registering for and participating in the Event, you, on behalf of yourself and your heirs, executors, administrators, and legal representatives, irrevocably waive, release, and forever discharge the ABBF Parties from any and all claims, demands, actions, or liabilities of any kind arising out of or connected with any such accident, injury, disability, illness, or death, and agree that neither you nor your heirs, representatives, or assigns shall have any claim, demand, or right of action against the ABBF Parties in relation thereto, to the fullest extent permitted by applicable law. To the maximum extent permitted by Applicable Law, ABBF and the ABBF Parties are not liable for ordinary and inherent risks of participation, or for losses caused by the participant's own acts or omissions or by circumstances beyond ABBF's reasonable control. Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or any other liability that cannot lawfully be excluded or limited. Nothing in these Terms is intended to waive statutory consumer rights or remedies.

10. Photography, Video & Media

ABBF and its authorised media partners may photograph or film the Event. Participation may result in incidental appearance in event documentation, crowd footage, race coverage or reporting. Where ABBF proposes to use an identifiable participant image specifically for promotional, fundraising or advertising purposes, ABBF will provide an appropriate consent/opt-out mechanism, subject to the form and process communicated at registration. Where a minor participates, any required guardian consent will be obtained.

A separate media consent, where provided, is not the same as acceptance of these Terms or the Privacy Policy. You may contact ABBF using the details below regarding future promotional use, but withdrawal may not require ABBF to recall media already lawfully published or distributed.

11. User-Generated Content

If you submit or post text, photographs, video, testimonials or other content to ABBF or an official Run InSync channel ("User Content"), you represent that you have the necessary rights and permissions to do so. You grant ABBF a non-exclusive, royalty-free, worldwide licence to host, reproduce, adapt, publish and display the User Content for Run InSync and ABBF's related event, reporting and non-misleading promotional purposes, subject to applicable law and the Privacy Policy. ABBF may remove User Content that it reasonably considers unlawful, infringing, unsafe, abusive or inconsistent with the Event's purpose.

12. Event Changes, Weather, Cancellation & Postponement

ABBF may modify the route, start time, venue, category format, operational arrangements or other Event details for safety, logistical, regulatory, weather or public-interest reasons. Significant changes will be communicated through the Platform or another reasonable participant communication channel. Cancellation, postponement and refund consequences are governed by the Return & Refund Policy, subject to Applicable Law.

13. Platform, Third-Party Services & Availability

The Platform may rely on third-party services, including payment, hosting, communications, timing, analytics and registration technologies. ABBF will take reasonable steps to keep the Platform operational, but does not guarantee uninterrupted or error-free availability. Third-party services may be subject to their own terms and privacy policies.

Nothing in this clause removes ABBF's responsibility for services that ABBF itself provides or for statutory obligations that cannot lawfully be excluded.

14. Intellectual Property

The Run InSync name, logo, event branding and ABBF materials are owned by ABBF or used under licence. Unless ABBF gives prior written permission, you may use event materials made available to you only for personal, non-commercial purposes and may not commercially exploit ABBF's trademarks or branding, create confusingly similar branding, or reproduce substantial portions of the Platform content.

You retain ownership of User Content to the extent you own it, subject to the licence in Section 11. Nothing in these Terms transfers ownership of your intellectual property to ABBF.

15. Disclaimers and Limitation of Liability

To the maximum extent permitted by Applicable Law, ABBF is not liable for indirect, incidental, special or consequential loss, or for travel, accommodation, opportunity or similar costs arising from Event changes or non-participation, except to the extent such liability cannot lawfully be excluded or results from ABBF's own non-excludable wrongdoing or breach.

Where Applicable Law permits a monetary limitation, ABBF's aggregate liability for a specific claim arising directly from the registration transaction will not exceed the Registration Fee actually paid for the affected Entry, except that this limit will not apply to liability that cannot lawfully be capped or excluded. This clause does not limit any statutory consumer remedy that cannot lawfully be limited.

16. Indemnification

You agree to indemnify ABBF and its representatives against reasonable losses, liabilities and costs arising directly from (a) your material breach of these Terms or Event-specific rules, (b) your unlawful or fraudulent conduct, (c) materially false information knowingly supplied by you, or (d) a third-party claim that your User Content infringes that person's rights. This obligation does not apply to the extent the relevant loss was caused by ABBF's own breach, negligence, wilful misconduct or other non-excludable wrongdoing.

17. Suspension and Termination

ABBF may suspend, restrict or terminate your access to the Platform or cancel an Entry where ABBF reasonably believes you have materially breached these Terms, supplied false or fraudulent information, created a safety/security risk, or used the Platform unlawfully. Where practicable, ABBF will provide notice and an opportunity to correct the issue, except where immediate action is reasonably required for safety, fraud prevention, legal compliance or protection of the Platform or others. Refund consequences are governed by the Return & Refund Policy and Applicable Law.

18. Force Majeure

ABBF will not be treated as in breach for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, extreme weather, epidemic/pandemic conditions, government restrictions or orders, public-safety measures, war, terrorism, civil unrest, strikes, major infrastructure failure, telecommunications or power failure, or other events that materially prevent or compromise safe Event operations. The participant consequences for postponement or cancellation are governed by the Return & Refund Policy and Applicable Law.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to Applicable Law, disputes arising from these Terms or the Event may be brought before the competent courts at Pune, Maharashtra. Nothing in this clause prevents a consumer from exercising any statutory right to approach a consumer commission or other authority that has jurisdiction under applicable law, nor does it restrict the jurisdiction of statutory bodies such as the Data Protection Board of India where applicable.

20. Changes to These Terms

ABBF may update these Terms by posting a revised version on the Platform with a new "Last updated" date. Where required by law, ABBF will provide additional notice or obtain fresh consent. The version accepted at the time of a confirmed Registration will ordinarily govern that Registration, except for changes required by law, safety, regulatory requirements or other circumstances where prospective application is not reasonably practicable.

21. Consumer Protection and Statutory Rights

Nothing in these Terms is intended to exclude or reduce any right, remedy, protection or liability that applicable Indian law does not permit ABBF to exclude, including rights available under consumer-protection law, privacy/data-protection law and other mandatory laws.

22. Grievance Redressal

For registration, payment, refund, Platform or consumer grievances, contact ABBF using info@runinsync.in and +91 90111 40185. ABBF will maintain and display the name and designation of its Grievance Officer on the Platform where required by Applicable Law. Complaints will be acknowledged and addressed within the timelines prescribed by law, including any applicable consumer e-commerce grievance timelines.

23. Accessibility

ABBF aims to make the registration experience and Event information reasonably accessible. Participants who require an accommodation or assistance for registration or participation may contact info@runinsync.in as early as practicable. Any accommodation will be considered in light of the actual Event format, safety requirements, venue constraints and Applicable Law; ABBF will not make promises in this policy that exceed the arrangements it has actually confirmed.

24. Notices

Notices from ABBF may be provided by email, SMS/WhatsApp used for Event communications, Platform notices or other reasonable electronic means. Notices to ABBF may be sent to info@runinsync.in or the postal address below. Participants should keep contact details current so that important Event communications can be received.

25. General Provisions

  • Severability: If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in force.
  • Waiver: A failure or delay by ABBF to enforce a provision is not a waiver of future enforcement.
  • Assignment: You may not assign your rights or obligations under these Terms except where expressly permitted by ABBF or Applicable Law. ABBF may transfer or assign its rights and obligations in connection with an organisational restructuring or the Event, subject to Applicable Law.
  • Entire agreement: These Terms, the Privacy Policy, Return & Refund Policy and applicable Event-specific rules form the agreement governing the relevant Platform use and Registration, subject to any mandatory legal rights.
  • Electronic records: These Terms and electronic acceptances/communications may be maintained as electronic records in accordance with applicable Indian law.
